    In my experience as defendant and complainant in civil matters here I have found that the circuit 'judges' and 'recorders' will favour people who have a solicitor. This is mainly because the judges do not have much experience of law and have not ended up presiding because of knowledge of the law. If you represent yourself (and why wouldn't you when you know your case best and solicitors are expensive) you should be prepared for the judge to patronise you and be dismissive of you. But if you know the law and present yourself well you can persuade them to be fair and understanding to the 'common person' (that's you :) ). The court fees all increased recently to pay for the fancy new buildings and enhancements that have taken the small claims hearing from one desk and one judge in a small office to fancy full-scale courtrooms, with witness box and high judge's 'altar'. This all creates a dramatic effect and it is so that more cases can be taken more seriously in civil courts and generate a lot more money for HMCS. the fee for a set aside order used to be £85. The last time I looked it had shot up to £255. My advice is to use it as a last resort and be prepared for very high costs, and high risk. Get a solicitor unless you have a good grounding in law and can present yourself clearly, positively and confidently.

    In a claim for postal compensation I toolk a delivery company to court, my argument was how could they loose a 15kilo 1 meter high boxed item, their argument was, I did not have enhanced insurance against loss. The judge was completely unsuited to adjudicate on teh case as it relied on an understanding of Ebay (feedback issues et al) plus Paypal and how money is transferred or held etc.The judge was desperately obtuse to all things ebay, paypal etc etc, and actually questioned me as to the contents (which was a sea faring item and insultingly suggested, 'the box could have contained a kettle' he said, or the sobering, 'you have made this a crusade' (for justice, what an idiot, I believe he thought he had an air of Judge Rinder humour about him) Anyway Judge finds for the delivery service and their costs, as their Terms and Conditions are binding(even though I had found a legal act that argues unfair T and Cs.) I receive the court judgement telling me to pay the courier by such and such date, hmmm. Then I receive a signed for letter from the courier stating the amount I owe and that I must legally pay, BUT the letter goes onto say that they understand my annoyance at the court case result and WILL NOT be asking for payment to cover their costs!!!! Now in all honesty that is a exceptional OK OK I know we can query the loss of the expensive item, but in truth the ONLY PARTY TO BENEFIT from this action was the BRISTOL COUNTY COURT, I will not use the term'Justice; in their title as they have no concept of that. They charge excessive set up fees, and the judges appear to be well paid ignoramuses. What I have I learnt, DO NOT USE HER MAJESTYS SMALL CLAIMS, all they want is your money and its adjudicated by obtuse upper class twits.
